1. Scope
The following Terms and Conditions apply to all orders placed through our online shop Dancing Microbes. Our online shop is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or self-employed professional activity.

2. Contracting Party, Formation of Contract, Corrections
The purchase contract is concluded with Dancing Microbes. The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding invitation for the customer to submit a purchase offer. You may initially add our products to your shopping cart without obligation and correct your entries at any time before submitting your order using the correction tools provided during the ordering process.
By clicking the order button, you submit a binding offer to purchase the products in your shopping cart. This offer is binding on you for a period of 10 business days. A contract is only formed when we expressly accept your offer by confirmation email or when we dispatch the goods to you.
We reserve the right to decline orders without giving reasons. If we decline an order, we will notify you immediately by email. Any payments already made will be refunded promptly in such cases.

3. Contract Language, Storage of Contract Text
The contract language is German and English. The contract text is stored, but for security reasons is not accessible via the internet.

4. Delivery Conditions
4.1 Shipping Costs
Standard delivery is free of charge.
4.2 Delivery Options
We ship products to the delivery address provided during the ordering process.
We deliver by post only. Collection in person is unfortunately not possible.
We do not deliver to parcel lockers (Packstationen).
4.3 Print-on-Demand Products (Printify)
Certain products (e.g. mugs, tea towels) are produced using a print-on-demand process by our partner Printify, Inc., 195 Plymouth St, Brooklyn, NY 11201, USA, and dispatched directly to you. In these cases, the shipping contract is concluded between Printify and the customer; however, we remain your contractual partner for the purchase contract. Delivery times for Printify products may differ from other products and are generally 5–10 business days. As these products are produced individually to order, the right of withdrawal is excluded insofar as they constitute goods made to the customer's specifications.

5. Payment
The following payment methods are generally available in our shop:
Credit Card
You enter your credit card details during the ordering process. Your card will be charged immediately upon placing the order.
PayPal, PayPal Express
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, log in with your credentials and confirm the payment instruction. The payment transaction is processed by PayPal immediately after the order is placed. Further details are available during the ordering process.
Sofort by Klarna
To pay via Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate yourself accordingly and confirm the payment instruction. Your account will be debited immediately upon placing the order. Further details are available during the ordering process.
Google Pay
To pay via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, log in with your credentials and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further details are available during the ordering process.
Apple Pay
To pay via Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay activated, log in with your credentials and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further details are available during the ordering process.
Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options. Payment via Klarna is available to consumers only. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further details are available for each payment option and during the ordering process.
Purchase on Account via Klarna
The invoice amount is due 14 days after dispatch of the goods and receipt of the invoice.

6. Retention of Title
The goods remain our property until payment has been made in full.

7. Right of Withdrawal
7.1 Exclusion of the Right of Withdrawal for Perishable Goods
In accordance with Section 312g para. 2 no. 2 of the German Civil Code (BGB), there is no right of withdrawal for goods that can spoil quickly or whose expiry date would quickly be exceeded. This applies in particular to living fermentation cultures such as milk, water or kombucha kefir grains, starter cultures and other sensitive microorganisms. The right of withdrawal is therefore excluded for these products.
For online consultations and digital products (e.g. e-books), the separate provisions set out in our Cancellation Policy apply.
7.2 Online Consultations
(1) In addition to physical products, online consultations can be booked through the online shop.
(2) After purchase, appointments are arranged via a booking link provided to you.
(3) Consultations take place online via video call.
(4) The statutory right of withdrawal of 14 days from the date of purchase applies to online consultations without restriction. Within this period, you may withdraw from the contract without giving any reason and will receive a full refund.
After the 14-day withdrawal period has expired, the following cancellation policy applies: booked appointments may be rescheduled or cancelled free of charge up to 48 hours before the scheduled time. For later cancellations or no-shows, no refund will be given.
(5) The consultation serves exclusively for the sharing of knowledge and experience. It does not constitute medical advice and is not a substitute for medical diagnosis or treatment by doctors, alternative practitioners or other medical professionals.
(6) No health claims or promises of success are made during the consultation. No specific result is guaranteed.
(7) The customer is solely responsible for ensuring the technical requirements for participating in the online consultation (in particular a stable internet connection and a suitable device).

8. Damage in Transit
If goods are delivered with obvious damage caused during transport, please report this directly to the delivery person where possible and notify us immediately. Failure to report or contact us does not affect your statutory warranty rights. We accept no liability for damage caused by improper handling by the transport service provider. Our liability is limited to the proper handover of the goods to the transport service provider.

9. Warranty and Guarantees
9.1 Statutory Warranty Rights
The statutory warranty rights apply.
9.1.1 Note
We do not provide any warranty beyond the statutory requirements unless expressly stated for a particular product.
9.2 Obligation to Report Defects Promptly for Perishable Products
The customer is obliged to report obvious defects within 48 hours of receiving the goods. In the case of a later report, it is generally no longer possible to determine whether improper storage or handling by the customer was the cause.
9.3 Exclusion of Warranty for Improper Handling
Liability for defects is excluded if changes or deterioration were caused by the customer, in particular if they are attributable to improper storage, improper care, failure to follow the enclosed instructions, or natural product-related changes.

10. Liability
(1) Exclusion of Liability
We exclude all liability for damage arising from improper handling, storage or use of the kefir grains. The buyer is obliged to read the enclosed instructions carefully and to follow the guidance on use and storage of the kefir grains. Liability for damage resulting from failure to follow these instructions is excluded.
(2) Mandatory Liability
We are liable without limitation for claims arising from damage caused by us, our legal representatives or agents:
• in the event of injury to life, body or health,
• in cases of intent or gross negligence,
• in cases of assumed guarantees,
• and under the provisions of the German Product Liability Act (Produkthaftungsgesetz).
(3) Liability for Simple Negligence
In the event of a breach of essential contractual obligations – whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance the contracting party may regularly rely (cardinal obligations) – we are also liable for simple negligence. In such cases, liability is limited to foreseeable damage typical of the type of contract.
(4) Product Characteristics and Risks
The buyer is aware that kefir grains are a sensitive natural product that may change or deteriorate if handled incorrectly or insufficiently cared for. We accept no liability for damage, loss or changes resulting from the natural characteristics of the product, improper handling or use other than as intended. We accept no liability for natural changes or loss of activity caused by the customer's own fault.
(5) Consumer Notice
The probiotic cultures contained in our products may in rare cases cause allergic reactions or intolerances. We accept no liability for health consequences attributable to individual intolerances or allergies of the customer. Customers are strongly advised to consult a doctor or nutritionist before consumption if they have any concerns.

All text and image material created by us may not be copied or otherwise used without our express consent.

14. Applicable Law
German law applies exclusively. In relation to a consumer, this choice of law applies only to the extent that it does not restrict any mandatory legal provisions of the country in which the consumer has their habitual residence.
